Tasman District: Investigation into alleged assault

The Authority oversaw a police investigation into an allegation that an officer used excessive and unnecessary force against the complainant while police were executing a search warrant. 

The Police investigation determined the officer was justified in arresting the complainant for obstruction after they prevented police from seizing evidence under the warrant. The officer was entitled to use necessary force to overcome the complainant’s resistive behaviour and effect the arrest. 

After considering all the accounts of those involved and relevant witnesses police determined no assault had occurred. 

The Authority agrees with the findings of the police investigation.
