Police Officer unlawfully presents firearm in Bay of Plenty

The Authority oversaw a Police investigation into the actions of an officer in Bay of Plenty who unlawfully presented a firearm during an arrest in August 2018. Police carried out criminal and employment investigations into the officer's actions. The Authority agreed with the Police findings that the arrest was lawful, the officer had good reason to be carrying a Glock pistol but should not have pointed the firearm at the person being arrested, as he was compliant at the time. Police found that the officer had breached Police policy in relation to the use of firearms and appropriately addressed these issues with him.
