Waikato Police Prosecutor acted inappropriately

26 October 2020

The Authority oversaw a Police investigation into an allegation that a Police prosecutor acted inappropriately when attempting to gain a resolution for a family harm related charge. Police found that the officer informed the defendant's lawyer that all prosecution witnesses were present, and the case was ready to proceed, when that was not the case. Police had earlier determined to seek leave to withdraw the charge and advised the complainant that their attendance at court was not necessary.

The officer's actions were found to have brought Police into disrepute and breached the Code of Conduct. These actions were addressed through an employment process which reached an appropriate outcome. The Authority agreed with the Police findings and outcome.
