Complaint about Police questioning of a suspect

23 September 2020

The Authority oversaw a Police investigation after a lawyer complained about the conduct of an officer during an interview with the lawyer's client. The officer allegedly tried to undermine the lawyer, by telling the client that she needed to answer questions during the interview and that having a lawyer present was detrimental to the client's interests.

The Police investigation found that the allegations are not upheld, however some of the officer's comments towards the lawyer and client were unprofessional but they did not breach the client's rights or amount to misconduct. Police apologised to the lawyer and addressed the officer's actions during an employment process.

The Authority agrees with the Police findings.
