Auckland officer cleared of causing injury to a detainee during a search

The Authority oversaw a Police investigation into an allegation an officer broke a man’s wrist while searching him. The investigation found there was insufficient evidence to prove the officer caused the injury and considered it likely the man sustained the injury during an earlier fight, or when he fell over prior to the arrest. The Authority agreed with Police’s decision not to charge the officer with a criminal offence.

During the investigation, the Authority identified concerns about the level of medical care the man received while in custody. Police apologised to the complainant and spoke to the custody staff involved about the need to prioritise the safety of people in their custody. The Authority agrees with this approach.
