Allegation an officer allowed a drunk driver to continue driving after breathalysing him

9 November 2023

The Authority reviewed a Police investigation into an allegation an officer allowed a driver to continue driving after he had failed a breath test. The officer also failed to notice that a driver was disqualified.

The Police investigation found that the driver of the failed test had driven off, rather than being allowed to continue driving by the officer.  The disqualified driver was a separate driver who was later apprehended after passing a checkpoint compulsory breath test which did not require a driver’s licence check.

The Authority agrees with the Police findings.
