The Authority oversaw a Police investigation into two complaints alleging the use by Police of OC spray on bystanders during an arrest was unnecessary and excessive.
Police reviewed CCTV footage of the incident and found the use of OC spray was justified in the circumstances, as bystanders ignored instructions and obstructed officers attempting to conduct a lawful arrest.
Although Police concluded the officer’s actions were justified in law, they recognised this as a learning opportunity and took remedial action to address this with the officers involved.
The Authority agrees with the Police outcome and findings.
