The Authority oversaw a Police investigation into an allegation that officers used excessive force when arresting a male who had obstructed them while they were arresting another person.
Police were arresting a female when a male approached them aggressively. He was pepper sprayed and warned he would be tasered if he did not move away. A short time later, when more officers had arrived, the male was told he was under arrest as he was walking towards his nearby house. The male ignored the officers and stepped inside his house.
The male aggressively resisted arrest so officers used multiple tactical options while bringing the male into custody, including pepper spray, a sponge round and baton.
Police conducted a criminal investigation, and the decision was made not to charge any of the officers involved. We agree with this finding.
Police then undertook an employment process during which they determined all uses of force were justified but identified a breach of Police policy related to failing to provide the male with appropriate after-care.
We agree that the male was not provided appropriate aftercare. We do not believe the use of the sponge round was justified and found that it was not used in accordance with Police policy.
